Chief Judge Purwanto S. Abdullah elaborated on these strict conditions during a session held at the Jakarta Corruption Court on Monday, May 11. These stipulations are mandatory for Nadiem Makarim throughout his period of house arrest, underscoring the gravity of his legal situation.

Below are the 10 binding conditions Nadiem must comply with:

A. He must remain within his residence, located at The Residence at Dharmawangsa 2 Unit 108 RT/RW 01/02 in Pulo, Kebayoran Baru District, South Jakarta, for 24 hours a day, seven days a week.

B. He is strictly prohibited from leaving his residence for any reason, except for:

  1. Undergoing a surgical procedure scheduled for May 13, 2026, and subsequent medical treatment at Abdi Waluyo Hospital or another designated hospital.

  2. Medical check-ups that have received prior written permission from the Chief Judge, based on a written recommendation from his treating physician.

  3. Attending court hearings according to the schedule set by the Panel of Judges.

C. He must consent to having an electronic monitoring device attached to his body, provided the Jakarta Central Prosecutor’s Office has the necessary facilities. The accused is forbidden from removing, damaging, manipulating, or disrupting the device’s function. He must immediately report any damage and ensure the device remains active and charged at all times.

D. He is required to report directly to the Public Prosecutor at the Jakarta Central Prosecutor’s Office twice a week, specifically on Mondays and Thursdays, from 10:00 AM to 12:00 PM WIB, unless he is incapacitated due to post-operative health conditions, as evidenced by a doctor’s certificate.

E. He must surrender his Republic of Indonesia passport, any foreign passports if applicable, and all other travel documents to the Public Prosecutor at the Jakarta Central Prosecutor’s Office within 1×24 hours of this decree being issued.

F. He is prohibited from contacting, meeting, or communicating with witnesses or other defendants in this case or related cases, whether directly or indirectly, through face-to-face interactions, telephone calls, text messages, emails, social media, or any other means of communication.

G. He is forbidden from making any statements, interviews, or providing information to the mass media regarding this case without written permission from the Panel of Judges.

H. He is not permitted to receive guests other than immediate family members (spouse, partner, or biological children), legal counsel registered in the case file, and medical personnel assigned by a hospital to provide care.

I. He must grant access to officers designated by the Jakarta Central Prosecutor’s Office to enter and inspect his residence at any time to ensure compliance with the terms of his house arrest.

J. He is required to attend all court hearings as scheduled, unless he is incapacitated due to post-operative health conditions, as evidenced by a doctor’s certificate.

The panel of judges emphatically stated that any violation of these conditions by Nadiem could result in his detention status being reverted to state prison. This stern warning underscores the serious implications of non-compliance with the court’s order.

“Should the defendant violate one or more of the conditions stipulated in point 3 above, the defendant’s type of detention will be reverted to State Detention Center confinement,” Judge Purwanto affirmed, highlighting the court’s resolve.

Wearing a Detainment Detector Bracelet on His Ankle During Sentencing Hearing

During the reading of the indictment in the alleged Chromebook laptop procurement corruption case on Wednesday, May 13, at the Jakarta Corruption Court, Nadiem Makarim was visibly wearing a GPS detector bracelet around his ankle. This device is a tangible manifestation of his new house arrest status.

“I’m still wearing it (the detector device). Yes, it can’t be removed. We have no intention of violating the terms,” Nadiem explained to reporters on Wednesday, May 13, indicating his commitment to abiding by the court’s rules.

“Yes, it’s worn 24 hours, it cannot be removed,” he further clarified, emphasizing the constant nature of the monitoring. Nadiem Makarim also reiterated that he is not permitted to leave his home without explicit permission. “I’m not allowed (to leave the house). I can only be at home, I can’t go anywhere, and only for court hearings or hospital treatment,” Nadiem stated, outlining the strict limitations on his movement.

Demanded 18 Years in Prison and to Pay IDR 5.6 Trillion

In the latest hearing on Wednesday, May 13, Nadiem faced the prosecutor’s demands. He was sought an 18-year prison sentence and a staggering total restitution payment of IDR 5.6 trillion. This substantial demand reflects the severity of the alleged corruption charges against him.

Nadiem expressed his disappointment, asserting that the prosecutor’s demands were inconsistent with the facts presented during the trial. Conversely, the prosecutor’s team remained confident that their demands were firmly grounded in the evidence uncovered throughout the proceedings.

The decision to grant the change in Nadiem’s detention status to house arrest was primarily based on health considerations. It was revealed that Nadiem required an operation, which influenced the court’s compassionate ruling.

Following the sentencing hearing on Wednesday, Nadiem was admitted to the hospital for his scheduled surgery. His legal counsel confirmed that the operation has since been successfully completed, marking a critical phase in his recovery.

“His recovery is estimated to be around 3 to 4 weeks. Recovery can take place at home, provided the environment is sterile and hygienic,” stated Ari Yusuf Amir, Nadiem’s lawyer, on Thursday, May 14, detailing the post-operative care plan.

Summary

The Jakarta Corruption Court has transitioned the detention of former Minister Nadiem Makarim from state prison to house arrest, subject to ten strict conditions. These requirements include full-time residence confinement, the use of an electronic monitoring ankle bracelet, the surrender of travel documents, and limitations on communication and visitors. The court emphasized that any violation of these terms will result in his immediate return to state detention.

This decision was primarily granted due to Nadiem’s need for medical surgery, which has since been successfully completed. Despite his house arrest status, Nadiem currently faces a demand for an 18-year prison sentence and a restitution payment of IDR 5.6 trillion regarding an alleged corruption case. He remains under constant monitoring and is permitted to leave his residence only for scheduled court hearings or authorized medical treatments.
