The Military Court II-08 Jakarta has confirmed that the trial of four defendants involved in the acid attack on KontraS Deputy Coordinator, Andrie Yunus, will proceed as scheduled. This decision remains firm despite the South Jakarta District Court partially granting a pretrial motion filed by the Advocacy Team for Democracy (TAUD).
Major Chk Endah Wulandari, spokesperson for the Military Court II-08 Jakarta, clarified that the South Jakarta District Court’s ruling and the ongoing military trial address entirely different legal matters. The pretrial motion had specifically ordered the Jakarta Metro Police to continue their investigative process, a duty the police claim is already ongoing.
“The substance of the pretrial ruling is limited to directing the Jakarta Metro Police to continue an investigation that, according to the respondent, has never been halted and is still active,” Endah explained on Wednesday, June 3. Consequently, she emphasized that the pretrial outcome does not impact the military proceedings, which have already advanced to the prosecution’s sentencing demand phase.
Earlier, the South Jakarta District Court judge, Suparna, ruled in favor of the petitioner, TAUD, affirming their legal standing to represent Andrie Yunus. The court ordered the police to move forward with the legal process regarding police report number LP/A/222/III/2026/Sat Reskrim/Restro Jakpus/Polda Metro Jaya, filed on March 13, 2026.
While the civil pretrial motion concludes, the Military Court II-08 Jakarta continues to focus on the prosecution of four members of the Indonesian Armed Forces Strategic Intelligence Agency (BAIS TNI) accused of carrying out the attack. During the hearing on Wednesday, June 3, Military Prosecutor (Oditur Militer) Lieutenant Colonel Chk Mohammad Iswadi formally requested that the court sentence the four defendants—Sergeant Second Class Edi Sudarko, First Lieutenant Budhi Hariyanto Widhi, Captain Nandala Dwi Prasetyo, and First Lieutenant Sami Lakka—to two years and six months in prison.
The prosecution argued that the defendants are proven guilty of premeditated assault resulting in serious injury, citing violations of Article 467 paragraph (1) in conjunction with paragraph (2) and Article 20 letter C of the Criminal Code (KUHP). Following the sentencing demand, the defense team requested an opportunity to present their defense plea (pleidoi), which is scheduled to be delivered on Thursday, June 4.
Summary
The Military Court II-08 Jakarta has confirmed that the trial against four BAIS TNI members accused of attacking KontraS activist Andrie Yunus will continue as scheduled. The court clarified that the recent pretrial victory by the Advocacy Team for Democracy at the South Jakarta District Court does not affect the military proceedings, as the two legal processes address separate matters.
During the session on June 3, the military prosecutor requested a two-year and six-month prison sentence for the four defendants, citing charges of premeditated assault. The trial is currently moving toward the defense plea phase, which is set to take place on June 4.
