KPK sebut tahanan rumah Gus Yaqut bagian dari strategi, tak ada intervensi

The Corruption Eradication Commission (KPK) has clarified that the temporary transfer of former Religious Affairs Minister Yaqut Cholil Qoumas (YCQ), also known as Gus Yaqut, a suspect in the alleged hajj quota corruption case, to house arrest was an integral part of its overarching case handling strategy. The anti-graft agency firmly asserted that this decision was a collective institutional choice, not a personal one.

This explanation was delivered by Deputy for Enforcement and Execution, Asep Guntur Rahayu, at the Corruption Eradication Commission building in South Jakarta on Thursday, March 26. He elaborated that the decision to reallocate detention status had undergone thorough internal discussions, meticulously considering a spectrum of crucial aspects.

“To be clear, any request pertaining to this matter has been subject to extensive deliberation or exposure in a meeting. Therefore, it is unequivocally an institutional decision, not a personal one. Our considerations primarily encompass the legal norms—whether such provisions exist,” Asep stated, underlining the legal framework guiding their actions.

Beyond the foundational legal basis, the commission also carefully weighed the potential public impact and the strategic imperatives of the ongoing investigation. Asep emphasized that these factors played a significant role in their assessment.

“Furthermore, we also took into account the ramifications and other pertinent issues. Critically, the overall strategy for managing this case itself was a key consideration,” he added. “As I previously mentioned, this change in detention status serves as a strategic maneuver applicable to every phase, particularly during the investigation stage.”

Asep further suggested that the public’s disappointment regarding the temporary house arrest, far from being a setback, actually signifies a robust form of support for the KPK in its commitment to prosecuting the case. He noted that the public outcry had, in fact, catalyzed positive progress in the investigation.

“On the contrary, this is a profound expression of support for us. We are immensely grateful to the Indonesian public, as the information and backing they have provided have enabled us to accelerate the process. For instance, Mr. YCQ was examined yesterday, and today we see very positive developments that we intend to disclose this coming Monday,” Asep elaborated. He stressed that “Without public support, these advancements would undoubtedly not have occurred, and the handling of this case might have been considerably prolonged.”

Asep also reiterated that the timing of Yaqut’s house arrest before the Eid al-Fitr (Lebaran) holiday was directly linked to the objective of expediting the case proceedings. “I must emphasize that this was a strategic move specifically tied to the investigation, aimed at achieving faster progress in managing this particular case,” he affirmed.

Denials of Secrecy and External Intervention

Addressing concerns, Asep firmly refuted any suggestions that Yaqut’s temporary detention transfer was conducted surreptitiously. He maintained that all relevant parties, mandated by law to be informed, had indeed received notification.

“To my knowledge, there was no secrecy involved. We have already provided notification to all parties who, according to the law, must be informed,” Asep declared. He also explicitly denied that the transfer was a result of any external interference. “As far as I am aware, there was no such intervention,” he asserted.

It is important to note that Yaqut Cholil Qoumas has since been returned to the KPK detention center on Tuesday, March 24. During his brief period of house arrest, Yaqut had reportedly expressed gratitude for the opportunity to celebrate Lebaran at home with his parents.

The Hajj Quota Corruption Case

In this high-profile case, Gus Yaqut has been named a suspect alongside his former special staff member, Ishfah Abidal Aziz, also known as Gus Alex.

The alleged scheme involving the manipulation of hajj quotas reportedly took place across the years 2023 and 2024. These quotas were purportedly arranged in exchange for illicit fees. The practice involved demanding these fees from Special Hajj Organizers (PIHK), essentially hajj travel agencies. Subsequently, these costs were then passed on by the PIHKs to prospective special hajj pilgrims, inflating the price of their travel packages.

Both Gus Yaqut and Gus Alex are suspected of playing pivotal roles in orchestrating these hajj quota arrangements. While the KPK has indicated that a certain amount of fees flowed to both individuals, the precise value has not yet been detailed.

The suspects face charges under the Anti-Corruption Law, primarily related to financial losses incurred by the state. The KPK estimates these state losses in this intricate case to be a substantial Rp 622 billion.

During his initial detention, Gus Yaqut maintained his innocence, asserting that he never received a single cent from the hajj quotas. He claimed his actions were solely motivated by ensuring the safety and welfare of the pilgrims. Similarly, Gus Alex stated he had provided comprehensive information to investigators, expressing his hope that his testimony would bring the truth to light. Furthermore, Gus Alex explicitly denied receiving any orders from Gus Yaqut in connection with this alleged bribery.

The initial decision by the KPK to transfer Yaqut to house arrest had indeed sparked considerable public criticism. Following this public reaction, the KPK subsequently reinstated Yaqut’s detention at the Rutan (detention center).
